[ENG] Angola and the European Union Sign Sustainable Investment Agreement

The recent Presidential Decree No. 127/24, published and in effect since June 18, 2024, approves the Sustainable Investment Facilitation Agreement between the Republic of Angola and the European Union. This agreement aims to attract, expand, and retain bilateral investments, focusing on economic diversification and promoting sustainable development.

Objectives and Measures of the Agreement

The Agreement acknowledges the importance of economic and social growth and environmental protection for sustainable development, driven by foreign investment. To achieve these goals, measures are adopted to enhance transparency, impartiality, and predictability, simplify investment authorization procedures, prevent and resolve disputes, and promote sustainable practices in environmental and labor rights, aligned with the Sustainable Development Goals of the UN Agenda 2030.

Key Solutions Provided

  1. Transparency and Access to Information: Commitment to publish and make relevant information available to investors.
  2. Simplification of Procedures: Elimination of the need for applicants to approach multiple authorities for investment authorizations.
  3. Acceptance of Electronic Formats: Possibility of submitting investment authorization requests in electronic format.
  4. Investment Facilitation Focal Points: Establishment of contact points for investors on measures affecting investment.
  5. Additional Measures: Other actions that facilitate investment and contribute to sustainable development goals.

Equal Treatment and Combating Corruption

The Agreement stipulates that each party must provide investors of the other party with treatment equal to that granted to investors from other countries. It also emphasizes the need for measures against corruption, money laundering, terrorism financing, fraud, and tax evasion.

Implementation and Supervision

To ensure the effective implementation of the Agreement, an Investment Facilitation Committee has been established, composed of representatives from Angola and the European Union. This committee will oversee the application of measures, promote investment, and resolve any problems or disputes.

O recente Decreto Presidencial n.º 127/24, aprova o Acordo de Facilitação do Investimento Sustentável entre a República de Angola e a União Europeia. Este acordo visa atrair, expandir e reter investimentos bilaterais, com foco na diversificação económica e promoção do desenvolvimento sustentável.

Objetivos e Medidas do Acordo

O Acordo reconhece a importância do crescimento económico, social e da proteção ambiental para o desenvolvimento sustentável, impulsionado pelo investimento estrangeiro. Para alcançar estes objetivos, são adotadas medidas que reforçam a transparência, imparcialidade e previsibilidade, simplificando os procedimentos de autorização de investimentos, prevenindo e resolvendo litígios, e promovendo práticas sustentáveis em termos ambientais e de direitos laborais, alinhadas com os Objetivos de Desenvolvimento Sustentável da Agenda 2030 da ONU.

Principais Soluções Previstas

  1. Transparência e Acesso à Informação: Compromisso de publicação e disponibilização de informações relevantes aos investidores.
  2. Simplificação dos Procedimentos: Eliminação da necessidade de os requerentes se dirigirem a múltiplas autoridades para autorização de investimentos.
  3. Aceitação de Formatos Eletrónicos: Possibilidade de submissão de pedidos de autorização de investimento em formato eletrónico.
  4. Pontos Focais de Facilitação: Estabelecimento de pontos de contacto para investidores sobre medidas que afetam o investimento.
  5. Medidas Adicionais: Outras ações que facilitem o investimento e contribuam para os objetivos de desenvolvimento sustentável.

Tratamento Igualitário e Combate à Corrupção

O Acordo estipula que cada parte deve proporcionar aos investidores da outra parte tratamento igual ao concedido aos investidores de outros países. Também reforça a necessidade de medidas contra a corrupção, branqueamento de capitais, financiamento do terrorismo, fraude e evasão fiscal.

Implementação e Supervisão

Para assegurar a implementação eficaz do Acordo, foi criado um Comité de Facilitação do Investimento, composto por representantes de Angola e da União Europeia. Este comité supervisionará a aplicação das medidas, promoverá o investimento e resolverá eventuais problemas ou diferendos.
