[EN] Regulations on Licensing for Occupational Safety, Hygiene, and Health Services

Presidential Decree No. 179/24 of 1 August establishes a new set of rules for the licensing and provision of Occupational Safety, Hygiene, and Health (SHST) services in Angola, reinforcing the need for a systematic and rigorous approach to managing occupational safety and health.

 

SHST Service Modalities

The regulation allows companies to choose between three SHST service modalities:

  1. Internal Service: The employer must have qualified human resources and specific equipment within the organisation. If it involves several companies, these must be located within the same space or a maximum distance of 2 km.
  2. Inter-Company Service: Different companies can create a shared service for their workers, based on an agreement between the parties. This service should be established in the company that offers the best conditions.
  3. External Service: Companies may outsource SHST services, but this does not exempt them from the legal responsibility of ensuring the safety and health of their workers.

 

Authorisation and Registration

To operate any of the mentioned services, companies must obtain authorisation or registration with the General Labour Inspectorate (IGT):

  • Internal and Inter-Company Services: These are subject to registration, requiring the submission of documents such as the application, legalisation of the requesting entity, qualifications of the technicians, and a list of equipment used.
  • External Services: These require formal authorisation from the IGT, through the submission of documents such as the authorisation request, commercial registration certificates, identification of the legal representative, and details on subcontracted activities and equipment used.

 

Inspection and Audit Process

After submitting the documents, the competent authority schedules an inspection to verify the compliance of the facilities and services. This inspection is crucial, as a positive compliance report is necessary for the issuance of an operational certificate valid for three years. Additionally, changes to facilities or equipment require a new inspection.

The regulation also provides for periodic audits to ensure that SHST services maintain the required quality. Audits can be voluntary or triggered by complaints.

 

Medical Obligations and Health Examinations

SHST services must ensure the presence of an occupational physician, who must dedicate at least one hour per day for every group of 10 or 20 workers, depending on the risk of the activity. This physician can be responsible for up to three different companies, provided they adhere to a monthly work limit of 40 hours.

Medical examinations are mandatory and must be conducted in various situations, such as upon hiring, returning to work after 30 days of absence, changing roles, and contract termination. Each examination must result in the issuance of a Labour Fitness Certificate (AAL), which must be approved by the competent authority.

 

Record Maintenance and Penalties

One of the most stringent aspects of the regulation is the requirement to maintain workers’ medical records for at least 20 years after the termination of the employment relationship. Failure to comply with this and other requirements can result in significant fines, ranging from 10 to 150 national minimum wages, depending on the severity of the violation.

O Decreto Presidencial n.º 179/24 de 1 de Agosto estabelece um novo conjunto de regras para o licenciamento e a prestação de serviços de Segurança, Higiene e Saúde no Trabalho (SHST) em Angola, reforçando a necessidade de uma abordagem sistemática e rigorosa na gestão da segurança e saúde ocupacional.

 

Modalidades de Serviço SHST

O regulamento permite que as empresas escolham entre três modalidades de serviços de SHST:

  1. Serviço Interno: O empregador deve contar com recursos humanos qualificados e equipamentos específicos dentro da própria organização. Caso abranja várias empresas, estas devem estar situadas no mesmo espaço ou a uma distância máxima de 2 km.
  2. Serviço Inter-Empresas: Empresas diferentes podem criar um serviço comum para os seus trabalhadores, mediante acordo entre as partes. Este serviço deve ser estabelecido na empresa que apresente as melhores condições para tal.
  3. Serviço Externo: As empresas podem contratar serviços externos de SHST, mas isso não as exime das responsabilidades legais de garantir a segurança e saúde dos seus trabalhadores.
Autorização e Registo

Para operar qualquer um dos serviços mencionados, as empresas devem obter autorização ou registo junto à Inspecção-Geral do Trabalho (IGT):

  • Serviços Internos e Inter-Empresas: Estão sujeitos a um registo, que requer a submissão de documentos como o requerimento, a legalização da entidade solicitante, qualificações dos técnicos e a lista de equipamentos utilizados.
  • Serviços Externos: Necessitam de uma autorização formal da IGT, mediante a apresentação de documentos como o pedido de autorização, certidões de registo comercial, identificação do representante legal, e detalhes sobre as actividades de subcontratação e equipamentos utilizados.

Processo de Vistoria e Auditoria

Após a submissão dos documentos, a entidade competente agenda uma vistoria para verificar a conformidade das instalações e serviços. Esta vistoria é crucial, pois só com um relatório de conformidade positivo é que o certificado de operação, com validade de três anos, será emitido. Além disso, alterações nas instalações ou nos equipamentos exigem uma nova vistoria.

O regulamento também prevê auditorias periódicas para garantir que os serviços de SHST mantêm a qualidade exigida. As auditorias podem ser voluntárias ou solicitadas em resposta a reclamações.

 

Obrigações Médicas e Exames de Saúde

Os serviços de SHST devem garantir a presença de um médico do trabalho, que deve dedicar pelo menos uma hora por dia para cada grupo de 10 ou 20 trabalhadores, dependendo do risco da actividade. Este médico pode ser responsável por até três empresas diferentes, desde que respeite o limite de 40 horas de trabalho por mês.

Os exames médicos são obrigatórios e devem ser realizados em várias situações, como na admissão, retorno ao trabalho após 30 dias de ausência, mudança de função e rescisão contratual. Cada exame deve resultar na emissão de um Atestado de Aptidão Laboral (AAL), que deve ser homologado pela entidade competente.

 

Manutenção de Registos e Penalidades

Um dos aspectos mais exigentes do regulamento é a obrigatoriedade de manter os registos clínicos dos trabalhadores por um mínimo de 20 anos após a cessação da relação laboral. O não cumprimento desta e outras exigências pode resultar em coimas significativas, que variam entre 10 a 150 salários mínimos nacionais, dependendo da gravidade da infração.
